You have the right to refuse to sign the settlement agreement if you believe it is not a fair offer. However, you should be aware that there are risks involved in rejecting a settlement agreement. If your employer goes through the dismissal process and your dismissal is fair, you are only entitled to statutory severance pay, which may be less than what was offered to you in the settlement agreement. You may also have to pay your attorney`s fees yourself, as your employer`s obligation to pay some or all of your attorney`s fees can only apply if you choose to sign the agreement. Your employer is unlikely to cover the cost of your legal advice during settlement negotiations, so you should carefully consider whether you believe you can reach a much better deal before taking this approach.
